Terms of Use

1. Introduction

By using H5GameSite and the H5GameSite website (collectively, the “Service”), you (“you” or “User”) agree to be bound by these Terms of Use (“Terms”). H5GameSite (referred to as “we,” “us,” or “our”) reserves the right to update or change these Terms at any time without prior notice. Any new features or enhancements added in excess of the current Service shall be subject to these Terms. Continued use of the Service after any such changes constitute your acceptance of those changes. If you do not agree with any part of these Terms, you may not access or use the Service.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. You represent and warrant that you are at least 18 years old and legally capable of entering into binding contracts. If you are under 18, you represent that you have obtained consent from your parent or guardian, and they agree to be bound by these Terms on your behalf.

2. Account Terms

• Accounts registered by automated methods (bots, scripts, or other automated means) are not permitted and will be deleted immediately without notice.
• We do not allow artificially inflated clicks, traffic, or any engagement manipulation by third parties.
• H5GameSite supports Google’s initiative to enable a free and open web. You must comply with Google’s Content Policies and Ads policies, including but not limited to the following guidelines:
  • AdSense Content Guidelines
  • AdSense Program Policies
• Any games or other content that breach the above guidelines will be removed immediately, and your account may be suspended or terminated at our sole discretion.

3. Prohibited Content

3.1 Illegal Content

We do not allow any content that is illegal, promotes illegal activity, or infringes on the legal rights of others. Any such content discovered on the Service will be removed.

3.2 Intellectual Property Abuse

We do not allow content that:

• Infringes copyright, trademark, patent, trade secret, or other intellectual property rights.
• Sells or promotes the sale of counterfeit products. Counterfeit goods are those that bear a trademark or logo identical to or substantially indistinguishable from the trademark of another business, intended to deceive users into believing they are genuine.

3.3 Dangerous or Derogatory Content

We do not allow content that:

• Incites hatred against, promotes discrimination of, or disparages an individual or group on the basis of race, ethnicity, religion, disability, age, nationality, veteran status, sexual orientation, gender, gender identity, or other characteristics associated with systemic discrimination or marginalization.
• Harasses, intimidates, or bullies an individual or group.
• Threatens or advocates for physical or mental harm to oneself or others.
• Exploits others through extortion or blackmail.

3.4 Animal Cruelty

We do not allow content that:

• Promotes cruelty or gratuitous violence toward animals.
• Promotes the sale of products obtained from endangered or threatened species.

3.5 Misrepresentative Content

3.5.1 Misleading Representation

We do not allow content that:

• Misrepresents, misstates, or conceals information about the publisher, content creator, purpose of the content, or the content itself.
• Falsely implies affiliation with, or endorsement by, another individual, organization, product, or service.

3.5.2 Unreliable and Harmful Claims

We do not allow content that:

• Makes claims that are demonstrably false and could significantly undermine participation or trust in an electoral or democratic process.
• Promotes harmful health claims or contradicts authoritative scientific consensus on a major health crisis.
• Contradicts authoritative scientific consensus on climate change.

3.5.3 Deceptive Practices

We do not allow:

• Enticing users to engage with content under false or unclear pretenses.
• Attempting to steal personal information or trick users into sharing personal information.
• Promoting content, products, or services using false, dishonest, or deceptive claims.
• Coordinating with other sites or accounts to conceal or misrepresent your identity or material details about yourself, especially in content related to politics, social issues, or matters of public concern.
• Directing content about politics, social issues, or matters of public concern to users in a country other than your own, if you misrepresent or conceal your country of origin or other material details about yourself.

3.6 Manipulated Media

We do not allow content that deceives users through manipulated or synthetic media related to politics, social issues, or matters of public concern.

3.7 Enabling Dishonest Behavior

We do not allow content that:

• Helps users mislead others (for example, forging documents or credentials).
• Promotes hacking, cracking, or provides instructions, equipment, or software that tamper with or provide unauthorized access to devices, software, servers, or websites.
• Enables a user, or promotes products or services that enable a user, to track or monitor another person without their consent. This does not include licensed private investigation services or parental monitoring of minors under their supervision.

3.8 Malicious or Unwanted Software

We do not allow content that:

• Contains malicious software (“malware”) that may harm or gain unauthorized access to a computer, device, or network.
• Violates Google’s Unwanted Software Policy.

3.9 Sexually Explicit Content

We do not allow content that:

• Includes graphic sexual text, images, audio, video, or games.
• Contains non-consensual sexual themes, simulated or real.

3.10 Compensated Sexual Acts

We do not allow content that may be interpreted as promoting sexual acts in exchange for compensation.

3.11 Mail Order Brides

We do not allow content that facilitates marriage arrangements with foreign nationals for compensation.

3.12 Adult Themes in Family Content

We do not allow content that is made to appear appropriate for a family audience but contains adult themes (such as graphic sex, violence, or other depictions unsuitable for children or general audiences).

3.13 Child Sexual Abuse and Exploitation

We do not allow content that:

• Sexually exploits or abuses children or promotes the sexual exploitation or abuse of children. This includes all child sexual abuse materials.
• Endangers children, including but not limited to:
  • “Child grooming” (e.g., befriending a child online to facilitate sexual contact or exchanging sexual imagery with a child).
  • “Sextortion” (e.g., threatening or blackmailing a child by alleging possession of their intimate images).
  • Sexualization of a minor (depicting or encouraging the sexual abuse or exploitation of children).
  • Trafficking of a child (e.g., advertising or solicitation of a child for commercial sexual exploitation).

4. Cancellation and Termination

You have the right to terminate your use of our Service at any time. Upon termination, all games and data associated with your account may be deleted. All provisions of these Terms which by their nature should survive termination (including ownership provisions, warranty disclaimers, indemnity obligations, and limitations of liability) shall continue in full force and effect.

We reserve the right to terminate or suspend your account and access to the Service immediately, without prior notice or liability, if you breach any provision of these Terms or for any other reason. If applicable law requires us to provide notice of termination or cancellation, we may do so by posting it on the Service or by sending a communication to any address (email or otherwise) that we have for you in our records.

We will not be liable to you or any third party for any termination or suspension or any actions taken by us in connection therewith.

5. Modifications to the Service

H5GameSite reserves the right, at any time and without notice, to modify or discontinue the Service (or any part thereof), temporarily or permanently. It is your responsibility to periodically review these Terms for updates. If you do not agree with any changes to these Terms, your sole remedy is to stop using the Service. Your continued use will be deemed acceptance of any modifications.

6. Limitation of Liability

To the fullest extent permitted by applicable law, H5GameSite, its affiliates, officers, directors, employees, agents, and licensors (collectively, “Released Parties”) shall not be liable for any indirect, incidental, special, consequential, or punitive damages whatsoever, including but not limited to:

• Damages for loss of profits, goodwill, data, or other intangible losses;
• Any loss arising from (i) your use or inability to use the Service; (ii) the cost of procuring substitute goods or services resulting from any goods, data, information, or services purchased or obtained, or messages received or transactions entered into through or from the Service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the Service; or (v) any other matter relating to the Service.

You are solely responsible for ensuring adequate security protection and backup of your data and/or equipment used in connection with your use of the Service. You agree not to assign or transfer your account to another person. We reserve the final right to interpret these Terms.

7. Indemnification

As a condition of your access to and use of the Service, you agree to indemnify, defend, and hold harmless H5GameSite and its successors, assigns, affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, losses, damages, judgments, awards, costs, or expenses (including reasonable attorneys’ fees and costs) arising out of or relating to:

• Your access to or use of the Service;
• Your violation of these Terms;
• Your violation of any rights of another party; or
• Any content you submit, post, or transmit through the Service.

This indemnification obligation shall survive termination of your account and your use of the Service.

8. Applicable Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in the United States of America to resolve any dispute arising out of or relating to these Terms or your use of the Service.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect. These Terms constitute the entire agreement between you and H5GameSite regarding the Service, superseding any prior agreements.

9. Links to Other Websites

Our Service may contain links to third-party websites or services not owned or controlled by H5GameSite. H5GameSite has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that H5GameSite shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

The inclusion of any link on the Service does not imply endorsement by H5GameSite of the site or its content. We strongly advise you to read the terms and privacy policies of any third-party websites you visit.

10. General Conditions

• (I) Your use of the Service is at your own risk. The Service is provided on an “as-is” and “as-available” basis. Technical support is available only to account holders via the “Contact Us” form.
• (II) H5GameSite, its subsidiaries, affiliates, and licensors do not warrant that:
  • a) The Service will be uninterrupted, secure, or available at any particular time or location;
  • b) Any errors or defects will be corrected;
  • c) The Service is free of viruses or other harmful components;
  • d) The results of using the Service will meet your requirements.
• (III) You acknowledge and understand that H5GameSite uses third-party vendors to provide the necessary hardware, software, networking, storage, and related technology required to run the Service.
• (IV) You must not modify, adapt, hack, or reverse-engineer the Service or any part thereof, or modify another website so as to falsely imply that it is associated with H5GameSite.
• (V) You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, your use of the Service, or access to the Service.
• (VI) Verbal, physical, written, or any other abuse (including threats) of any H5GameSite employee, member, or officer will result in immediate account termination and potential legal action.
• (VII) H5GameSite does not warrant that:
  • a) The Service will meet your specific requirements;
  • b) The Service will be uninterrupted, timely, or error-free;
  • c) The quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations.
• (VIII) You expressly understand and agree that H5GameSite shall not be liable for any payments or monetary transactions that occur through your use of the Service. You agree that H5GameSite shall not be liable for any issues regarding financial or monetary transactions between you and any other party.
• (IX) The failure of H5GameSite to vigorously enforce any right or provision of these Terms shall not be construed as a waiver of such right or provision.
• (X) If any part of this agreement is deemed illegal or unenforceable in a particular jurisdiction, such provision shall be severed, and the remaining provisions will continue in full force and effect.

11. Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for consequential or incidental damages. Accordingly, some of the above limitations may not apply to you.

12. Data Location

By using the Service, you agree that all data processed or held in connection with the Service (as outlined in our Privacy Policy) may be stored and processed in the United States of America or any other country where H5GameSite or its service providers maintain facilities.

13. Other Rights

Whenever possible, you may access, update, or request deletion of your personal information directly through your account settings.
